DELIVERY UPDATE: Due to the continuing impacts of COVID-19 on the global supply chain network we are experiencing delays that may affect when products arrive at our warehouses.

Harbour Outdoor ships across the continental USA and to Hawaii. Please contact us for deliveries outside of these location as we will ship worldwide.

Lead Times + Deliveries: All lead times are based on Harbour Outdoor’s estimates of the commercial conditions, supplier lead times, supplier-related issues and current commitments from suppliers. Due to factors beyond our control regarding backorders, general production, freight delays, adverse weather, etc., Harbour Outdoor cannot and does not guarantee lead times. Orders may not be cancelled and deposits will not be refunded due to extended lead times or late deliveries.

Premium White Glove Delivery: Services include delivery, installation and removal of all packing materials. The delivery fee quote is based on the number of pieces of furniture and includes all assembly, up to two flights of stairs (20 steps), placement and removal of all packing materials. Delivery fees are based on your zip code’s proximity to our warehouse. Delivery crews are not allowed to move your existing furnishings and/or take away any old furniture pieces in their truck

* Many apartment buildings require a COI (certificate of insurance) before delivery. If needed, please notify Harbour via your salesperson or email us at customerservice@harbouroutdoor.com. If we are not made aware you may be responsible for additional fees incurred.

Will Call Pick-up and Merchandise Delivery: Pick-up or delivery of product must be concluded within five (5) business days of the notice to you that the merchandise is available. Storage fees at the rate of $100 per item per day will be applied to the final invoice if pick-up or delivery does not occur within that period. Any order that exceeds a 90-day storage period may be forfeited without compensation, at the discretion of Harbour Outdoor. Such forfeiture does not excuse you from your obligation to pay storage fees nor excuse the payment of any remaining balance on your account.

Will Call Pick Up: Will Call Pick-up is available at our two warehouse locations in Southern California. A Fee of $50 will be charged.

Split Shipments: Due to supply chain challenges, a portion of your order could be delayed. In the event that you require your order to be partially shipped, an additional shipping fee will be applied.

Harbour Outdoor wants you to be satisfied with your purchase. In the event you are not completely satisfied, contact Customer Service to return or exchange your item(s) within 30 days of the delivery date. Please note that returns or exchanges are not accepted for special orders. Returned merchandise must be in new, undamaged, unused, and unwashed condition with original packaging material and original tags attached. Other exclusions may apply. Contact us for details. Unfortunately, our showrooms cannot accept returns.

Your item (s) will be inspected and exchanges, credits or refunds will be issued for the purchase price, less a 25% restocking fee plus the cost of return freight. Any taxes charged will be refunded in accordance with applicable laws. Delivery fees are non-refundable with the exception of manufacturer defects or transit damage. Harbour reserves the right to refuse returns or exchanges of items that are not in new condition due to damage or misuse by the client.

Refunds will be credited in the same form of payment paid. If merchandise is paid with cash or by check, a corporate check will be mailed to you within 45 days.

Special Orders

Special orders begin production immediately upon order placement. As a result, the item(s) cannot be canceled, changed, returned or refunded at any time. A non-refundable 50% deposit will be charged when you place your order. You have 48 hours to make any changes or cancel your special order. Prior to shipping your outstanding balance is fully due.

Claims

In the case of visible damages to the packaging upon delivery, a client must inspect the product and note any damages on the transport company’s delivery receipt. Client must immediately send pictures to customerservice@harbouroutdoor.com.

In the case of non-visible damages, the client needs to report and send pictures of the damages to customerservice@harbouroutdoor.com no later than 48 hours after the receipt of the goods.

Warranty: Harbour Outdoor’s warranty varies on our different products and materials used.

All Frames have a 3 year warranty
Outdoor Cushion Foam have a 1 year manufacturer warranty
• Indoor Cushions have a 1 year warranty
Glass has a 2 year warranty (not including cracks, chips, breaks or any damage from accidental misuse)
Laminam – 2 year warranty. Color, texture and veining are not guaranteed as each piece is unique.

Please address all detailed warranty questions with your relevant salesperson or on our company website. Any warranty provided by Harbour Outdoor is non-transferable and is limited to those who purchased the product from Harbour Outdoor or from a Harbour Outdoor authorized reseller, and only while the product is owned by the original owner. Proof of purchase and original ownership is required for any warranty claims. The warranty provided by Harbour Outdoor, if any, does not cover any of the following: all normal wear and tear; superficial or aesthetic defects that do not affect the use and operation of the merchandise; damage caused by neglect, temperature, or moisture extremes; damage due to mishandling, neglect, improper setup, damage in travel, shipping damage or use under other than what is classified as normal conditions; normal changes in wood grain, fading of color and/or aging of any finish.

As-Is, Floor Models + Clearance Items: Items sold in this category are sold on a “Final Sale” basis. Returns and exchanges for “As-Is,” “Floor Model” or “Clearance” products will not be accepted under any circumstances. No warranty is provided for any such items.

Warranty Claims Procedures: All warranty claims must first be submitted to Harbour Outdoor at Customerservice@harbouroutdoor.com. If authorized, an RMA number will be issued to you along with return instructions. No returns or warranty claims will be accepted unless accompanied by an RMA number. Harbour Outdoor is not responsible for, and may reject, warranty claims which are not accompanied by an RMA number.

You are solely responsible for the cost of shipping as well as the risk of loss during transport. Merchandise not in a returnable state may be (i) rejected, (ii) forfeited and destroyed or (iii) may be returned to you with the shipping costs billed to you, at Harbour Outdoor’s sole discretion.

Limitation of Liability: Harbour Outdoor is not responsible for any misuse of our product that may result in injury or worse on any property and/or persons. Harbour Outdoor is not liable for any loss of use, revenue or profit, diminution in value, any consequential, indirect, incidental, special, exemplary, or punitive damages, whether arising out of breach of contract, or tort otherwise, and regardless of whether such damages were foreseeable and whether or not Harbour Outdoor has been advised of the possibility of such damages, and notwithstanding the failure of any agreed or other remedy of its essential purpose.

In no event shall Harbour Outdoor’s aggregate liability arising out of or related to this agreement, whether arising out of or related to breach of contract, tort (including negligence), or otherwise, exceed the total amount paid to Harbour Outdoor for the goods sold hereunder, or $2,000, whichever is less.

WHAT INFORMATION DO WE COLLECT?

”Personal Information” is data that allows someone to identify or contact you, including, for example, your name, address, phone number, email address, as well as any other non–public information about you that is associated with or linked to any of the foregoing data.

”Non-Personal Information” means data that is not associated with or linked to your Personal Information; Non-Personal Information does not, by itself, permit the identification of individual persons.

We collect Personal Information and Non-Personal Information, as described below.

We collect Personal Information as required to offer Services, as listed in the Terms and Conditions, as voluntarily provided by you in the course of correspondence or registration, and as otherwise identified below.

In addition, we collect certain information which cannot be used to personally identify any user, such as anonymous, aggregate or statistical data.

In order to use some Services, you may be required to complete the applicable registration form accessible on the Site. All persons who register are referred to as ”Registered Users.” Some Services may not require registration.

The Company collects and maintains a record of all data provided through such registration forms, e.g. your name, email, mailing addresses, phone number, zip code and password. For example, individual users who desire to order a Product (as defined in the Terms and Conditions) must provide certain contact information, shipping information, billing information and financial information (e.g., a credit card number and expiration date, which will be collected by us or our third-party payment processing service providers).

Each Registered User may be provided a unique username and password that enable access to the Service. We may track the use of those usernames and passwords in order to collect and maintain records of individual transactions conducted through the Services by Registered Users, and those records may be associated with each Registered User’s individual account profile within the Company system. Credit cards are not stored on our site and passwords are not stored in plain text.

We also collect other types of Personal Information that you provide to us voluntarily via cookies, such as your operating system and version, and other requested information if you contact us via email regarding support.

We also collect and maintain records of information that you voluntarily provide to us. For example, we may ask you to participate in a survey, and may ask you to provide Personal Information, such as age, gender or other demographic data.

If you enter into a contest or promotion on our Site, we will collect the information you provide to participate in the contest or promotion. If you provide us feedback or contact us via email, we will collect your name and email address, as well as any other content included in the email, in order to send you a reply. However, unless such information is necessary for the Service or required by the Terms and Conditions, we do not require you to provide such information to us.

We collect additional information through the Site and the Service that is not associated with any online account or registration information, and that cannot be used to personally identify you. Non-Personal Information (“NPI”) ordinarily includes aggregate, summary, or other anonymous data, and may include, by way of example, statistics regarding popularity of particular pages within the Site, or information regarding types of Internet browsers used by Registered Users.

”Cookies” are small files placed on a user’s computer by a Web site in order to facilitate use of that Website. For example, a cookie may contain information about a user’s preferences, so that the Web site automatically complies with those preferences whenever the user visits that Web site. When using the Service, we may create ”cookies” on your computer for purposes of facilitating and maintaining your current user session, and may collect Personal Information using those cookies in order to enable Company to identify you in connection with the Service and to track use of the Service for purposes consistent with this policy.

To make our Site and Services more useful to you, our servers (which are hosted by a third-party service provider WP Engine (http://www.wpengine.com) collect information from you, including your browser type, operating system, Internet Protocol (IP) address (a number that is automatically assigned to your computer when you use the Internet, which may vary from session to session), domain name, and/or a date/time stamp for your visit.

The Site is not directed to children and children are not eligible to use our Services. Protecting the privacy of children is very important to us. We do not collect or maintain Personal Information from people we actually know are under 18, and no part of our Site or Service is designed to attract people under 18. If we later learn that a user is under 18, we will take steps to remove that user’s Personal Information from our databases and to prevent the user from utilizing the Site and the Service.

If you decide to invite a third party to create an Account, we will collect your and the third party’s names and email addresses in order to send an email and follow up with the third party. You or the third party may contact us to request the removal of this information from our database.

WHERE DO WE STORE YOUR INFORMATION?

Our Service is operated in the United States. If you are located outside the United States, please be aware that any information you provide to us may be transferred to, and stored in, the United States. By using the Service or otherwise providing us with information, you hereby consent to this transfer.

At times, for orders originating within the EU or UK or being delivered to the EU or UK, we may use third parties located within the EU or UK to process such orders. In so doing, we take steps to ensure those entities will process your information in a manner consistent with this Privacy Policy.

Your Personal Information may be processed in the country in which it was collected and in other countries, including the United States, where laws regarding processing of Personal Information may be less stringent than the laws in your country.

COLLECTED INFORMATION – USE AND DISCLOSURE

The Company uses information collected from the Site and Service in several ways, as outlined in this policy. For example, we use Personal Information as needed to provide Site and Services, to create Accounts and to communicate with Registered Users.

We also use both Personal Information and Non-Personal Information when evaluating ways to improve the Site and the Service. As further described below, in limited circumstances we may disclose collected information, including Personal Information, to certain third parties in connection with providing Services or as required by law. We will not use or disclose collected information in ways different from what is described in this policy unless otherwise required by law.

We also use information collected through the Site and the Service to communicate with Registered Users from whom such information was collected in order to provide promotional materials about us. However, unlike communications which are necessary to provide Services (”Necessary Communications”), promotional communications are optional (”Optional Communications”), and Company will refrain from sending that kind of information to you if you inform us that you prefer not to receive them, as described in more detail below.

Company uses NPI in a variety of ways, including, by way of example, to evaluate the performance of the Site and Service and the general preferences of users, or to generate anonymous statistics for our benefit or for our business partners. Because NPI is entirely anonymous, and therefore can never be used by us to identify you, this policy does not limit our ability to use or disclose Non-Personal Information. We may create NPI records from Personal Information by excluding information (such as your name) that make the data personally identifiable to you.

If we collect information through the Site and/or the Service that you provide to us voluntarily through online forms or surveys, through email communications or by other means, we will treat that information as described above, as applied to both Personal Information and Non-Personal Information.

As a necessary part of providing Services, we may disclose information collected from you as described in this policy. For example, we may disclose certain Personal Information about you to our third-party service providers (e.g., our third-party payment processors), so long as they are only using the Personal Information to provide services to us. If another company acquires our company, business, or our assets, that company will possess the Personal Information collected by it and us and will assume the rights and obligations regarding your Personal Information as described in this Privacy Policy.

Under certain limited circumstances, we may cooperate with legal investigations and/or we may be subject to legal requirements to disclose information collected through the Site or Services, such as, by way of example, to a court or a governmental agency, and our policy is to provide such cooperation and comply fully with all such legal requirements.

We may also disclose Personal Information to protect or defend the rights or property of Company or users of the Services and/or to investigate any violation or potential violation of the law, this Privacy Policy, or Terms and Conditions. The disclosures contemplated by this paragraph (”Necessary Disclosures”) are necessary if you wish to use the Service. As mentioned above, Company may use and disclose NPI without restriction. If you do not want us to make such Necessary Disclosures, or to use NPI without restriction, you must not use the Service.

We may use third-party advertising companies to serve ads when you visit our Site. These companies may use information (not including your name, address, email address or phone number) about your visits to this and other websites in order to provide advertisements about goods and services of interest to you. We will be sure your name is removed from our list (and the list we may share with third parties) as soon as possible after we receive your request. If you enter and win a contest or other promotion, you expressly consent to (a) Company providing your Personal Information to the third party providing the prize for the contest or other promotion, solely to provide you such prize and (b) Company publicly disclosing your name, city, state and the fact that you won the contest or promotion. ACCESSING PERSONAL INFORMATION COLLECTED FROM YOU

Registered Users may update or delete Personal Information contained within that Registration Profile at any time, by contacting us via mail, email or phone (see “Questions” section below). Subsequent uses or disclosures of information by us will reflect those changes, but we have no ability to update any information previously disclosed to any third party.

Please note that we may be required to keep information and not delete it (or to keep this information for a certain time, in which case we will comply with your deletion request only after we have fulfilled such requirements).

We implement a variety of security measures to maintain the safety of your personal information. Your personal information is contained behind secured networks and is only accessible by a limited number of persons who have special access rights to such systems, and are required to keep the information confidential. When you place orders or access your personal information, we offer the use of a secure server. All sensitive/credit information you supply is transmitted via Secure Socket Layer (SSL) technology and then encrypted into our databases to be only accessed as stated above.

Furthermore, access to Personal Information is physically restricted within our own offices, so that only certain of our employees are granted access to information as appropriate to perform specific jobs and tasks (e.g., performing customer service).

Please be aware that, although we endeavor to provide security for information in our possession and control, no security system can protect against all potential security breaches, and we bear no liability for uses or disclosures of Personal Information or Non-Personal Information arising in connection with the theft thereof.
